Terms of Service

1. PARTIES

  1. Didata Tecnologia Ltda., a private legal entity registered under CNPJ no. 60.643.880/0001-46, headquartered in Belo Horizonte, Minas Gerais, hereinafter referred to as "Didata" or the "Platform";
  2. User, an individual over 18 years old or a minor represented by a legal guardian, duly registered on the Platform.

2. PURPOSE

These Terms govern the conditions for access to and use of the Didata Platform, an educational digital application that uses Artificial Intelligence (AI) resources to generate study content and automatically evaluate activities.

3. ACCEPTANCE OF TERMS

  1. By creating an account, checking the acceptance box, or using the Platform, the User declares awareness of and full agreement with these Terms and the Privacy Policy.
  2. If the User does not agree with any provision, use of the Platform must stop immediately.

4. REGISTRATION AND ACCOUNT

  1. Access to the Platform requires login. To register, the User must provide at least a valid full name and email address.
  2. The User undertakes to provide true, complete, and updated information, and is civilly and criminally liable for inaccuracies.
  3. The User is responsible for the confidentiality of account credentials and agrees not to share them with third parties.

5. PLANS, PAYMENTS, AND CANCELLATION

  1. Didata offers paid plans with different features. The specific conditions of each plan will be detailed in the purchase area within the Platform.
  2. The User may cancel the subscription at any time, subject to automatic renewal rules and minimum terms when applicable. Amounts already paid are non-refundable unless otherwise stated.
  3. Failure to pay by the due date may result in default and may lead to suspension or termination of the subscription, without prejudice to collection measures.
  4. Changes in prices or terms will be communicated to the User at least 30 days in advance.

6. USE OF THE PLATFORM

  1. The Platform must be used exclusively for educational purposes within Brazilian territory.
  2. The User is prohibited from:
    • Publishing, transmitting, or storing illegal content or content that infringes third-party rights;
    • Reverse engineering, copying, modifying, or assigning parts of the Platform;
    • Using unauthorized automated mechanisms.

7. AI-GENERATED CONTENT AND COPYRIGHT

  1. AI-generated content is provided "as is" and without guarantees of accuracy.
  2. Didata grants a personal, non-exclusive, non-transferable license to use content within the Platform.
  3. The User retains ownership of their own content but grants Didata an irrevocable license to store and display it.

8. PRIVACY AND DATA PROTECTION (LGPD)

  1. Didata collects and processes: name, email, and data generated through platform use.
  2. Processing follows the legal bases provided by the LGPD for:
    • User authentication;
    • Educational content generation;
    • Statistical analysis and platform improvement;
    • Institutional communications and marketing, with opt-out.
  3. The User has the rights established by the LGPD (access, correction, deletion, etc.).
  4. Questions should be sent to the DPO at contato@didata.ai.
  5. Contact data may be used for marketing, always ensuring an unsubscribe option.
  6. Didata does not share data with third parties for marketing without consent.
  7. Technical and administrative security measures are adopted to protect data.
  8. Security incidents will be communicated to the User and the ANPD.

9. USER RIGHTS AND OBLIGATIONS

  1. The User must use the Platform in compliance with these Terms and applicable law.
  2. The User is responsible for all submitted content and its accuracy.
  3. Non-compliance may result in account suspension or cancellation.

10. LIABILITY AND LIMITATIONS

  1. Didata seeks service continuity but is not liable for:
    • Unavailability due to force majeure or third-party failures;
    • Errors or inaccuracies in AI-generated content;
    • Indirect damages or data loss.
  2. Overall liability is limited to the amount paid in the previous 12 months.

11. SUSPENSION AND TERMINATION

  1. Didata may suspend or terminate accounts that violate these Terms.
  2. The User may close the account at any time through settings or by requesting it from Didata.

12. CHANGES TO THE TERMS

  1. Didata may update these Terms at any time; material changes will be communicated to the User.
  2. Continued use after an update implies acceptance.

13. COMMUNICATIONS

All notices must be sent to contato@didata.ai. Didata will send communications to the registered email address.

14. GOVERNING LAW AND VENUE

  1. These Terms are governed by Brazilian law, especially the Brazilian Internet Civil Framework, the Civil Code, and the LGPD.
  2. The parties elect the courts of Belo Horizonte, Minas Gerais.
